Arkansas Joins Suit to Block Clean Power Plan

On August 11, 2015, the State of Arkansas joined 16 other states in filing a lawsuit against the U.S. Environmental Protection Agency ("EPA") in the United States Court of Appeals for the District of Columbia Circuit to seek review of the final Clean Power Plan released last week. The Petition alleges that EPA erroneously concluded that the plaintiff states' State Implementation Plans are substantially inadequate with respect to periods of startup, shutdown and malfunction and must be revised. Arkansas is represented in the lawsuit by Assistant Attorney General Jamie Leigh Ewing.
